IMPORTANT: PLEASE READ CAREFULLY These Terms of Service (“Terms”) govern your access to and use of Antarctic Games (“Antarctic,” “we,” “us,” or “our”), including our website, games, proxy services, mirrors, domains, and other related services (collectively, the “Service”). BY USING THIS WEBSITE OR ANY PART OF THE SERVICE, YOU AGREE TO THESE TERMS. By continuing to access or use Antarctic, you acknowledge that you have read, understood, and agree to comply with these Terms to the extent permitted by applicable law. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE. These Terms are intended to establish reasonable rules for using Antarctic and to explain the limits of our responsibility. They do not give you permission to break the law, violate school or workplace rules, or interfere with other people’s rights. 1. Nature of the Service 1.1 Antarctic is an entertainment-focused website that may provide access to games, web applications, proxy or relay functionality, and other internet content. 1.2 Antarctic may use alternative domains, mirrors, redirects, or other methods to maintain access to the Service. Providing these access methods does not mean that Antarctic encourages or authorizes users to violate rules, policies, filters, firewalls, or other restrictions applicable to them. 1.3 You are responsible for determining whether you are permitted to access and use Antarctic on the device or network you are using. 1.4 We do not guarantee that Antarctic will always be available, unblocked, undetected, uninterrupted, secure, or accessible from any particular network or location. 2. School, Workplace, and Network Policies 2.1 You are responsible for following all rules and policies that apply to your use of Antarctic, including policies established by schools, employers, libraries, parents or guardians, network administrators, internet service providers, device-management systems, or other organizations. 2.2 Antarctic does not encourage or authorize the use of the Service in violation of those policies. 2.3 To the maximum extent permitted by applicable law, Antarctic and its operators are not responsible for disciplinary action, loss of privileges, device restrictions, network restrictions, account restrictions, suspension, or other consequences resulting from your use of Antarctic in violation of rules or policies that apply to you. 2.4 If your school, employer, parent or guardian, network administrator, or another authorized person prohibits your use of Antarctic, you must follow that restriction. 3. Proxy and Relay Services 3.1 Antarctic may provide proxy, relay, or similar network-access functionality that allows requests to be made through Antarctic infrastructure. 3.2 The proxy is provided for lawful and legitimate purposes only. You may not use Antarctic’s proxy or relay services to: * Gain unauthorized access to systems, accounts, networks, or information. * Conduct attacks, scanning, exploitation, or disruption against other systems. * Distribute malware, viruses, or other harmful software. * Conduct phishing, credential theft, fraud, or other deceptive activity. * Intentionally overload or abuse Antarctic or third-party infrastructure. * Conceal or facilitate unlawful activity. * Circumvent security measures for malicious purposes. * Violate the terms, policies, or rights of third-party services. * Access or distribute content in violation of applicable law. 3.3 We may block destinations, limit traffic, terminate connections, or restrict proxy access when reasonably necessary for security, abuse prevention, legal compliance, operational reasons, or protection of third parties. 3.4 Using Antarctic’s proxy does not give you ownership of or additional rights to third-party websites, software, services, or content. 4. Acceptable Use You agree not to use Antarctic to: (a) violate any applicable law or regulation; (b) infringe the rights of another person or organization; (c) harass, threaten, stalk, defraud, deceive, or intentionally harm another person; (d) distribute malware, viruses, phishing pages, credential theft tools, or similar harmful material; (e) attempt unauthorized access to Antarctic, its infrastructure, another user’s information, or a third-party system; (f) interfere with, overload, disrupt, or damage the Service; (g) bypass or interfere with security controls, rate limits, anti-abuse systems, or other technical safeguards for malicious purposes; (h) use bots, crawlers, scrapers, or other automated systems in a manner that creates unreasonable load or abuse; (i) impersonate Antarctic or falsely claim to represent Antarctic; (j) use the Service to facilitate fraud or other unlawful activity; (k) intentionally exploit vulnerabilities in a manner that causes harm; or (l) otherwise use the Service in a manner that creates a significant legal, security, or operational risk to Antarctic or its users. 5. Games and Third-Party Content 5.1 Antarctic may provide access to games, applications, websites, media, embeds, and other content created or owned by third parties. 5.2 Third-party games, software, trademarks, logos, artwork, music, and other intellectual property remain the property of their respective owners unless explicitly stated otherwise. 5.3 Antarctic does not claim ownership of third-party content merely because it is accessible through the Service. 5.4 The inclusion of third-party content does not necessarily mean that Antarctic is affiliated with, endorsed by, or sponsored by the owner of that content. 5.5 Third-party content may be subject to separate terms, licenses, or restrictions established by its respective owners. 5.6 We do not guarantee that any particular game, application, website, or other third-party content will remain available. 6. Antarctic Intellectual Property 6.1 Unless otherwise stated, Antarctic’s original branding, website design, original graphics, original code, documentation, and other materials created by Antarctic are owned by or licensed to Antarctic. 6.2 You may not copy, redistribute, sell, commercially exploit, or reproduce Antarctic’s original materials without permission, except where permitted by applicable law. 6.3 The Antarctic name, branding, and original materials may not be used in a manner that falsely suggests sponsorship, partnership, or affiliation with Antarctic. 7. Privacy and Technical Information 7.1 Antarctic may process technical information that is reasonably necessary to operate, secure, maintain, and improve the Service. Depending on how the Service is configured, this may include information such as IP addresses, browser information, request information, device information, timestamps, and security or anti-abuse information. 7.2 Our actual data practices are described in the Antarctic Privacy Policy. 7.3 You should not submit sensitive personal information to Antarctic unless the Service specifically requests and is designed to handle that information. 7.4 We may retain technical information for as long as reasonably necessary for security, legal, operational, or other legitimate purposes, subject to applicable law and our Privacy Policy. 8. No Accounts 8.1 Antarctic does not currently require user accounts for ordinary access to the Service. 8.2 Because Antarctic does not use ordinary user accounts, certain settings, preferences, or access controls may depend on your browser, device, network, or other technical mechanisms. 8.3 You may not intentionally manipulate technical systems or identifiers for abusive purposes. 9. Security and Abuse Prevention 9.1 You may not intentionally compromise or attempt to compromise Antarctic’s security. 9.2 This includes attempting to: * Obtain unauthorized access to servers or infrastructure. * Steal, alter, or destroy data. * Circumvent security controls for malicious purposes. * Interfere with Antarctic infrastructure. * Exploit vulnerabilities in a way that causes harm. * Conduct denial-of-service or similar attacks. 9.3 Antarctic may use automated systems, traffic controls, rate limits, filtering, logging, or other security measures to protect the Service. 10. Third-Party Websites and Services 10.1 The Service may contain links to or provide access to third-party websites and services. 10.2 Antarctic does not control third-party websites and is not responsible for their content, policies, security, availability, or practices. 10.3 Your interactions with third-party services are governed by the terms and policies of those services. 10.4 Antarctic does not guarantee that third-party content is accurate, safe, lawful, appropriate, or free from malicious material. 11. Service Availability 11.1 Antarctic may modify, suspend, restrict, replace, or discontinue any part of the Service at any time. 11.2 Individual games, proxy endpoints, domains, mirrors, or other features may become unavailable without notice. 11.3 We do not guarantee uninterrupted operation, complete accuracy, compatibility with every device, or error-free performance. 11.4 Maintenance, technical failures, attacks, third-party outages, domain changes, hosting issues, or other circumstances may temporarily affect the Service. 12. Disclaimer TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANTARCTIC IS PROVIDED “AS IS” AND “AS AVAILABLE.” ANTARCTIC DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT GUARANTEE THAT THE SERVICE WILL REMAIN AVAILABLE, UNBLOCKED, PRIVATE, SECURE, OR COMPATIBLE WITH ANY PARTICULAR DEVICE OR NETWORK. 13. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANTARCTIC AND ITS OPERATORS, CONTRIBUTORS, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, LOSS OF DATA, LOSS OF PROFITS, LOSS OF ACCESS, DEVICE OR NETWORK ISSUES, THIRD-PARTY ACCOUNT RESTRICTIONS, SCHOOL OR EMPLOYMENT DISCIPLINARY CONSEQUENCES, OR OTHER CONSEQUENCES RESULTING FROM USE OF THE SERVICE. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. 14. Indemnification To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Antarctic and its operators from claims, liabilities, damages, losses, and reasonable expenses arising from: (a) your unlawful use of the Service; (b) your violation of these Terms; (c) your violation of the rights of another person or organization; or (d) your misuse of Antarctic’s proxy or other services. 15. Suspension and Restriction Antarctic may suspend, restrict, or terminate access to the Service, or to specific features, when reasonably necessary to: * Protect the Service or its users. * Prevent abuse. * Address security concerns. * Respond to legal requirements. * Investigate suspected violations of these Terms. * Protect third-party infrastructure. * Address technical or operational issues. We may take these actions with or without prior notice where permitted by law. 16. Changes to These Terms We may modify these Terms from time to time. The current version will be posted on Antarctic with an updated effective date or document version. Where required by applicable law, material changes will be communicated through an appropriate notice. Your continued use of Antarctic after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law. 17. Governing Law These Terms are governed by applicable law without regard to conflict-of-law principles, except to the extent that mandatory laws applicable to you provide otherwise. Nothing in this section is intended to remove rights that cannot legally be waived. 18. Severability If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect. 19. No Waiver Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later. 20. Entire Agreement These Terms, together with the Antarctic Privacy Policy and any other policies expressly incorporated into these Terms, constitute the agreement governing your use of the Service, except where additional terms expressly apply to a specific feature. 21. Your continued access to or use of the website or any other part of the Service constitutes your acceptance of these Terms to the extent permitted by applicable law.
